AI and Legal Person

What is a Legal Person?

An association, corporation, partnership, proprietorship, trust, or individual that has legal standing in the eyes of law. A legal person has legal capacity to enter into agreements or contracts, assume obligations, incur and pay debts, sue and be sued in its own right, and to be held responsible for its actions.

To have legal personality means to be capable of holding legal rights and obligations within a certain legal system, such as entering into contracts, suing, and being sued. Legal personality is a prerequisite to legal capacity, the ability of any legal person to amend (enter into, transfer, etc.) rights and obligations. In international law, consequently, legal personality is a prerequisite for an international organization to be able to sign international treaties in its own name.

What is AI?

According to the dictionary definition : the capacity of a computer to perform operations analogous to learning and decision making in humans.

 Can AI has Legal Personality?

If an AI entity assumes all the human behavior, can the entity be considered with legal personality.

I would like to explore this idea in details by trying to answer the following questions.

1.What is a standing point for granting legal personality to an AI entity?

2. Do we have a different rights classification for AI entities?

3. Do we need a separate area of law for AI judiciary – e.g. Ocean Laws?
